Exemption of Specified Principal's Qualification Programs and Supervisory Officer's Qualification Programs

Private Career Colleges Act, 2005

Directive

Consistent with the exclusion of professional development and skill upgrading programs from the definition of "vocational program" in the Private Career Colleges Act, 2005, private entities are exempt from the requirement to obtain the approval of the Superintendent to offer the programs listed below if the programs are offered exclusively to:

  • members of the Ontario College of Teachers,
  • students who are not members of the Ontario College of Teachers but who have prior experience as a teacher, principal or education leader in a school or school board located outside the province of Ontario that receives regular and ongoing operational funding from the province in which it is located, or
  • students who are not members of the Ontario College of Teachers but who have previously been employed or otherwise engaged as a teacher, principal or education leader by a band, a band council, or education authority that is authorized by the Crown in right of Canada to provide education for First Nation pupils.

The programs to which this exemption applies are the following programs accredited pursuant to O. Regulation 347/02 made under the Ontario College of Teachers Act, 1996:

  1. A program leading to a part 1 principal's qualification;
  2. A program leading to a part 2 principal's qualification; and
  3. A program leading to a supervisory officer's qualification (SOQP).

Definitions

Band has the same meaning as in the Indian Act (Canada).
Band council has the same meaning as "council of the band" in the Indian Act (Canada).
Education authority has the same meaning as in the Education Act (Ontario).
Ontario College of Teachers means the College established under the Ontario College of Teachers Act, 1996.

Authority

Section 53(1)(c) of the Private Career Colleges Act, 2005 authorizes the Superintendent of Private Career Colleges to issue policy directives exempting private career colleges, or any class of them, from the requirement that they obtain approval for a specified class of vocational programs under section 23 of the Private Career Colleges Act, 2005.

Policy Directive Inapplicable to Other Programs

This policy directive does not affect the requirements set out in the Private Career Colleges Act, 2005 in respect of a vocational program in any other field, whether or not it is related to the programs set out above.

Effective Date

This policy directive is effective April 13, 2016.

This document is a legal document and is binding on all private career colleges. Every private career college shall comply with and be operated in accordance with this policy directive.
