OBJECTIVE: The purpose of this memo is to clarify parent signature requirements on Employment Ontario’s participant registration and placement agreement forms. BACKGROUND: On September 23, 2015, the Ministry posted updated forms for:
Prior to September 23, 2015, the forms in use provided for youth aged 16 and over to sign all of these forms – that is, the ES Participant Registration form as well as the two ES Training Incentive Placement Agreement forms. As of September 23, 2015, youth aged 16 and over continue to be permitted to sign the ES Participant Registration form as it is not a document that is intended to be legally binding. However, training placement agreement forms are documents that are intended to be legally binding. In Ontario, the minimum age requirement to sign such a document is 18. Therefore, a parent signature is required on both training placement agreement forms. The only exception is in the case of 16 or 17 year-old participants who have confirmed with a service provider that s/he has withdrawn from parental control. In such cases, no parent signature is required. However, service providers are expected to document these situations in the participant’s file. Participants under 18 years of age who have not withdrawn from parental control and have not obtained their parent’s signature cannot take part in EO programs as final authority to make decisions on behalf of a minor child rests with his/her parent. Please note that these requirements apply to all Employment Ontario programs, including Youth Job Connection and in the future, Youth Job Connection: Summer.
