These particulars are posted following the issuance of an administrative monetary penalty (“AMP”) for which a review was requested. Penalties may be reviewed upon request within 15 days of receipt of a Notice of Contravention. The review decision is made considering not only the information originally available at the time the Notice of Contravention was issued, but also any new information not previously available that may have been supplied in support of the request for a review. On review, an administrative penalty may be upheld, rescinded or reduced. A review decision is final.

Subsection 38 (10) of the Private Career Colleges Act, 2005 – prohibition against hindering, obstructing or interfering with theSuperintendent or designate conducting an inquiry or examination, refusing to answer questions on matters relevant to the inquiry or examination, or providing the Superintendent or designate with information on matters relevant to the inquiry or examination that the person knows to be false or misleading. $1,000 a day There is insufficient evidence to establish that the London School of Business and Finance (“LSBF”) intentionally denied the Superintendent of designate access to records, which they were entitled to inspect, examine or copy. The evidence appears to indicate that the actions causing the records to be inaccessible were taken by individuals who worked for the Head Office of LSBF located in the United Kingdom and there is insufficient evidence to establish that these actions were caused or ordered by the registrant. The evidence, on balance, does not support that LSBF contravened subsection 38 (10) of the Act. The AMP ($1,000/day) issued to LSBF in Notice of Contravention #2014-077 is rescinded.
