These particulars are posted following the issuance of an administrative penalty for which a review was requested. Penalties may be reviewed upon request within 15 days of receipt of a Notice of Contravention. The review decision is made considering not only the information originally available at the time the Notice of Contravention was issued, but also any new information not previously available that may have been supplied in support of the request for a review. On review, an administrative penalty may be upheld, rescinded or reduced. A review decision is final.

Description Original Amount Review Decision

Act, s. 8 (1) – Prohibition against providing unapproved vocational programs

The Superintendent of Private Career Colleges (“Superintendent”) came to the reasonable belief that this School was offering an unapproved vocational program that required approval.

The School’s website, as viewed by a Designate of the Superintendent (“Designate”) found at http://deweycollege.ca/?page_id=3770 was advertising a "Joint Pre-Master program in Business Administration/Human Resources Management" offered by the School in collaboration with the University of Winnipeg.

The School also provided information to a Designate, posing as a prospective student, about the School’s joint Business Administration/Human Resources Management program.

Program details revealed students who completed first year courses at Dewey College receive a Diploma in Human Resource Management. Fees totaled $30,000 and were to be paid directly to the School. The program required completion of 16 courses, totaling 513 hours of instruction.

Original penalty: $2,000

Penalty of $1,000 per day is upheld. The penalty accumulated from October 31, 2013 to November 1, 2013 (inclusive).

Act, s. 7 – Prohibition against operating a private career college

Based on the evidence, the Superintendent came to the reasonable belief that this School was operating an unregistered private career college.

Daily penalty of $1,000

Original penalty: $2,000

Penalty of $1,000 per day is upheld. The penalty accumulated from October 31, 2013 to November 1, 2013 (inclusive).

Penalty following review: $2,000

Act, s. 9 – Prohibition against charging fee

Based on the evidence, the Superintendent came to the reasonable belief that this School was charging a fee in relation to an unapproved program that required approval.

Daily penalty of $1,000

Original penalty: $2,000

Penalty of $1,000 per day is rescinded.

Act, s. 11 – Restrictions on advertising and soliciting

Based on the evidence, the Superintendent came to the reasonable belief that this School was advertising an unapproved vocational program.
