These particulars are posted following the issuance of an administrative penalty for which a review was requested. Penalties may be reviewed upon request within 15 days of receipt of a Notice of Contravention. The review decision is made considering not only the information originally available at the time the Notice of Contravention was issued, but also any new information not previously available that may have been supplied in support of the request for a review. On review, an administrative penalty may be upheld, rescinded or reduced. A review decision is final.

Act, s. 11 – Restrictions on advertising and soliciting

On March 16, 2009 the Superintendent of Private Career Colleges (the “Superintendent”) registered Genesis Truck Training Ltd. (the “school”) as a private career college (“PCC”) under the Act.

On July 18, 2011 the school voluntarily ceased to operate as a PCC under the Act.

On November 14, 2011 a designate of the Superintendent advised the school that it must immediately cease advertising in any form that it is a registered PCC.

On August 16, 2013 a second designate of the Superintendent reviewed the school’s website at www.genesistrucktraining.com.

This website advertised AZ and DZ “professional truck driver” programs and presented claims of registration as a PCC and accreditation by the Ministry of Education. These claims were false.

$1,000 per day

Penalty of $1,000 per day is upheld. The penalty accumulated from September 9, 2013 to September 10, 2013 (inclusive).

The balance of the evidence indicates that the school was advertising an unregistered PCC and unapproved AZ and DZ programs and was aware of the requirements to register and obtain program approval prior to advertising these programs.

Act, s. 7 – Prohibition against operating a private career college

On March 16, 2009 the Superintendent registered the school as a PCC under the Act.

On July 18, 2011 the school voluntarily ceased to operate as a PCC under the Act.

On November 14, 2011 a designate of the Superintendent advised the school that it must immediately cease advertising in any form that it is a registered PCC.

On August 16, 2013 a second designate of the Superintendent reviewed the school’s website at www.genesistrucktraining.com. This website advertised AZ and DZ “professional truck driver” programs and presented claims of registration as a PCC and accreditation by the Ministry of Education. These claims were false.

$1,000 per day

Penalty of $1,000 per day is upheld. The penalty accumulated from September 9, 2013 to September 10, 2013 (inclusive).

The balance of the evidence indicates that the school was operating an unregistered PCC by advertising unapproved vocational programs and claiming to be a registered school. Evidence indicates that the school was aware of the requirements to register and obtain program approval prior to operating a PCC.
