These particulars are posted following the issuance of an administrative penalty for which a review was requested. Penalties may be reviewed upon request within 15 days of receipt of a Notice of Contravention. The review decision is made considering not only the information originally available at the time the Notice of Contravention was issued, but also any new information not previously available that may have been supplied in support of the request for a review. On review, an administrative penalty may be upheld, rescinded or reduced. A review decision is final.

Act, s. 8 (1) – Prohibition against providing vocational programs On March 14, 2013, two Designates visited the School to make inquiries under section 38 of the Act. While at the School, the Designates observed a photograph on the wall of the reception area showing a truck with the sign “TEC Transport Education Class AZ & DZ” on it. In addition, a representative of the School provided the Designates with copies of student files. |

Act, s. 9 – Prohibition against charging fee On March 14, 2013, two Designates visited the School to make inquiries under section 38 of the Act. During this visit, a representative of the School provided the Designates with copies of student files. Upon examination, the Designates found that 11 files contained an “enrollment application and contract” setting out “total tuition cost,” “registration/down payment,” and “balance due” for the School’s training program. |

Act, s. 11 – Restrictions on advertising and soliciting On March 14, 2013 and on April 4, 2013, a Designate viewed website advertising for the School at www.transporteducation.com. This website identified a trucking school and an AZ truck driver training program. |
