These particulars are posted following the issuance of an administrative penalty for which a review was requested. Penalties may be reviewed upon request within 15 days of receipt of a Notice of Contravention. The review decision is made considering not only the information originally available at the time the Notice of Contravention was issued, but also any new information not previously available that may have been supplied in support of the request for a review. On review, an administrative penalty may be upheld, rescinded or reduced. A review decision is final.

Description

Act, s. 46 (2) Compliance orders. Failure to comply with an order of the Superintendent made under s. 46 of the Act 

On January 24, 2017, the Harris Institute for the Arts Inc. was issued a compliance order pursuant to s. 46 of the Act, which included among others a requirement that the Harris Institute produce Instructor Qualification Forms for each instructor employed at the college. As of March 21, 2017, the Harris Institute had failed to provide copies of the Instructor Qualification Form for each instructor employed at the college.

The balance of evidence indicates that The Harris Institute for the Arts Inc., operating as Harris Institute: Failed to comply with an order of the Superintendent made under s. 46 of the Act, as it did not provide completed instructor qualification forms for all instructors within the timeframe prescribed by the Superintendent.

O. Reg. 415/06, s. 42. Requirement to keep a record of personal information of each instructor at the campus of the college at which the person is employed.

The Harris Institute failed to demonstrate that it kept copies of completed Instructor Qualification Forms for each instructor employed at its campus.
