These particulars are posted following Emmanuel Academy of Business, Healthcare & Technology Inc.’s, operating as Emmanuel Academy of Business, Healthcare & Technology (“Emmanuel Academy”), appeal of a Notice of Proposal to Revoke Registration before the Licence Appeal Tribunal under subsection 19 (3) of the Private Career Colleges Act, 2005.

On November 27, 2018, the Superintendent issued a Notice of Proposal to Revoke Registration to Emmanuel Academy. Emmanuel Academy provided written notice under subsection 19 (3) of the Act to appeal the decision before the Licence Appeal Tribunal. On July 9, 2019, the Licence Appeal Tribunal directed the Superintendent to carry out the Proposal to Revoke Registration.

Reasons for Decision

The Superintendent has revoked Emmanuel Academy’s registration for the following reasons:

  • Emmanuel Academy breached a condition of registration by failing to retain the services of a compliance monitor for the full duration required by conditions, thereby providing grounds to revoke Emmanuel Academy’s registration pursuant to subsection 18 (2) of the Act;
  • Emmanuel Academy contravened several provisions of the Private Career Colleges Act, 2005, by making unapproved changes to its vocational programs, failing to provide refunds to students, and failing to provide required notice of a change in the location of the campus, thereby providing grounds to revoke Emmanuel Academy’s registration pursuant to subsection 18 (2) of the Act;
  • Emmanuel Academy’s financial position as presented within its own statements to the Superintendent, in conjunction with the compliance monitor reports, and Emmanuel Academy’s most recent financial capacity assessment, did not suggest that Emmanuel Academy would be able to operate responsibly. In view of the information available Emmanuel Academy no longer satisfied each of the requirements of subsection 14 (1) of the Act and thereby providing grounds to revoke Emmanuel Academy’s registration.

Superintendent’s Action

On July 9, 2019, the Superintendent carried out the proposal to revoke the registration of Emmanuel Academy.
