These particulars are posted following the expiry of the 15-day period for New Way Truck & Forklift Driving School Ltd., operating as New Way Truck & Forklift Driving School to require a hearing of the Licence Appeal Tribunal under s.19(3) of the Private Career Colleges Act, 2005 (“the Act”). On September 13, 2019, the Superintendent issued a Notice of Immediate Suspension to New Way Truck & Forklift Driving School. On January 14, 2020, New Way Truck & Forklift Driving School surrendered its registration pursuant to section 22 of the Act and ceased to operate as a registered private career college in Ontario.

Reasons for Decision

The Superintendent suspended the registration of New Way Truck & Forklift Driving School for the following reasons:

  • Students enrolled into the New Way Truck & Forklift Driving School’s approved vocational programs were not receiving the program in the manner approved by the Superintendent, contrary to the interests of both current and prospective students;
  • Students enrollment contracts did not include all terms required by the Act and the Regulations, contrary to the interests of both current and prospective students;
  • Instructors employed to provide the New Way Truck & Forklift Driving School’s approved vocational programs either did not meet the requirements of the Act and the Regulations, or did not met and maintain the requirements of the Commercial Truck Driving (Class A) Training Standard, contrary to the interests of both current and prospective students;
  • New Way Truck & Forklift Driving School failed to comply with provisions of the Act and the Regulations, providing grounds to revoke the registration pursuant to subsection 18 (2) (C) of the Act;
  • New Way Truck & Forklift Driving School breached a condition of the registration, providing grounds to revoke the registration pursuant to subsection 18 (2) (B) of the Act;
  • The Superintendent was no longer satisfied that New Way Truck & Forklift Driving School meets all requirements set out in subsection 14 (1) of the Act, providing grounds to revoke the registration pursuant to subsection 18 (2) (A) of the Act; and,
  • At the time of the Immediate Suspension, New Way Truck & Forklift Driving School continued to operate in contravention of the Act and the immediate suspension of the registration prevented further contravention.

Details of Contraventions

As a result of on-site inquiries on August 15, 2019, and a follow up on August 21, 2019, designates of the Superintendent observed the following:

  • New Way Truck & Forklift Driving School employed persons as instructors in an approved vocational program who did not meet the requirements for instructors from both the Private Career Colleges Act, 2005 and the Commercial Truck Driving (Class A) Training Standard;
  • New Way Truck & Forklift Driving School admitted students who did not meet the admission requirements into an approved vocational program;
  • New Way Truck & Forklift Driving School failed to provide students receipts for payments made towards approved vocational programs;
  • New Way Truck & Forklift Driving School did not maintain student files in a manner consistent with the Private Career Colleges Act, 2005;
  • New Way Truck & Forklift Driving School did not complete student enrollment contracts with all of the required terms including, but not limited to:
    • The tuition the student would be required to pay;
    • The schedule of payments to be made for the vocational program;
  • New Way Truck & Forklift Driving School breached conditions of its registration as a private career college; and,
  • New Way Truck & Forklift Driving School breached conditions of program approval for its approved vocational programs.

Superintendent’s Action

On September 13, 2019, the Superintendent immediately suspended the registration of New Way Truck & Forklift Driving School. New Way Truck & Forklift Driving School remained suspended until the registration was surrendered by New Way Truck & Forklift Driving School pursuant to section 22 of the Act on January 14, 2020.
