These particulars are posted following the issuance of a Compliance Order against a registered private career college by the Superintendent of Private Career Colleges pursuant to s. 46 (1)/ (2) of the Act.

Contraventions

The Superintendent has ordered Best Payless Truck Driving School Ltd. to stop contravening the following sections of the Act and Ontario Regulation 415/06:

A. Section 23 (4) of the Act – Approval required to provide vocational programs

23 (4) The Superintendent may approve the provision of a specified vocational program by a private career college subject to such conditions as the Superintendent may specify and may, as a condition of the approval, specify performance indicators for the vocational program and standards and performance objectives that the vocational program must meet in addition to the performance indicators, standards and performance objectives set out in the Superintendent's policy directives.

B. Section 42 of Ontario Regulation 415/06 – Personal information RE: Instructors:

42. (1) No private career college shall employ a person as instructor in a vocational program at the college unless the instructor completes a form containing such personal information as may be required by the Superintendent under section 50 of the Act and submits the form to the college.

42. (2) The private career college shall keep a record of personal information provided under subsection (1) at the campus of the college at which the person is employed.


Required actions

By December 20, 2019 Best Payless Truck Driving School was required by the Superintendent to provide written confirmation signed by a person with authority to bind the cooperation, together with all available supporting evidence, confirming that they:

A. have provided the following items by e-mail to PCCCEU@ontario.ca, to the attention of Investigator Nancy Di Nino:

  1. a complete list of all instructors employed, engaged, or otherwise involved in the Registrant's Tractor Trailer-A program
  2. completed instructor qualification forms, including two letters attesting to the work experience of the instructor, for each instructor in the list above
  3. proof that each instructor met the instructor requirements provided by the Commercial Truck Driver Training Standard published by the Ministry of Transportation at the time of their employment with the Registrant
  4. d. proof that each instructor continues to meet the instructor requirements provided by the Commercial Truck Driver Training Standard published by the Ministry of Transportation (i.e. yearly updated abstracts)

B. Will keep a record of personal information for each instructor provided under subsection 42 (1) of the Regulations at the campus of the Registrant at which the person is employed;

C. Will offer Entry- Level Truck Training program in accordance with the Act, the Regulations, and the Commercial Truck Driver Training Standard (Class A) as set out by the Ministry of Transportation.


Compliance

The business responded and confirmed compliance with the Compliance order on February 18, 2020.
