These particulars are posted following the issuance of a Compliance Order against a registered private career college by the Superintendent of Private Career Colleges pursuant to s. 46 (2) of the Act.

Contraventions

The Superintendent has ordered 2375741 Ontario Inc., operating as A1 Transportation Academy (the “Registrant”) to:

A. Stop admitting students who fail to meet admission requirements into approved vocational programs contrary to section 19 of Ontario Regulation 415/06;

a. The Registrant uses an alternative admission test that has not been approved by the Superintendent for that purpose and has admitted students into approved vocational programs on the basis of that test, thereby contravening section 19 of O. Reg. 415/06, and breaching a condition of registration.

B. Provide by e-mail to PCCCEU@ontario.ca a list of all students currently enrolled into an approved vocational program with proof that the student met the requirements of section 19 of Ontario Regulation 415/06 on the day that they commenced the vocational program;

a. The Registrant uses an alternative admission test that has not been approved by the Superintendent for that purpose and has admitted students into approved vocational programs on the basis of that test, thereby contravening section 19 of O. Reg. 415/06, and breaching a condition of registration.

C. Shall, in every contract entered into by the Registrant and a student for the provision of a vocational program, include the terms prescribed by subsection 20 (1) of Ontario Regulation 415/06;

a. Investigators viewed vocational student contracts entered into by the Registrant and students for the provision of a vocational program that did not include an expected completion date and payment schedule as required by subsection 20 (1) of O. Reg. 415/06.

D. Shall employ as instructors only those persons who have completed a form containing such personal information as required by the Superintendent as required by subsection 42 (1) of Ontario Regulation 415/06;

a. Investigators requested the Registrant to produce Instructor Qualification Forms for each person engaged as an instructor in a vocational program. The Registrant stated it did not have a completed Instructor Qualification Form for the instructor Lakhvinder Singh contrary to subsection 42 (1) of O. Reg. 415/06.

E. Shall provide its approved vocational programs providing instruction leading to a Class A Driver’s License to adhere to the Commercial Truck Driver Training Standard (Class A), including only employing as instructor those persons who meet the instructor requirements of the Standard;

a. Investigators requested the Registrant to produce instructor qualifications for each person engaged as an instructor in the Registrant’s program leading to a Class A Driver’s License. The Registrant stated it did not have documentation to demonstrate that Lakhvinder Singh met the instructor requirements for the Commercial Truck Driver Training Standard (Class A);

F. Provide by e-mail to PCCCEU@ontario.ca a completed instructor qualification form for Lakhvinder Singh and proof that Lakhvinder Singh meets the instructor requirements of the Commercial Truck Driver Training Standard (Class A).

a. The Registrant has employed Lakhvinder Singh as an instructor in approved vocational program, leading to a Class A driver’s license without a completed Instructor Qualification Form and without proof that Lakhvinder Singh meets the requirements of the Commercial Truck Driver Training Standard (Class A).

Required Actions

By June 3, 2020 the Registrant is required by the Superintendent to provide written confirmation signed by a person with authority to bind the corporation, together with all available supporting evidence, confirming that they:

A. Have stopped using an alternative admission test that has not been approved by the Superintendent for the purpose of satisfying the requirements of section 19 of Ontario Regulation 415/06;

B. Have provided to PCCCEU@ontario.ca a list of all students currently enrolled into an approved vocational program with proof that the student met the requirements of section 19 of Ontario Regulation 415/06 on the day that they commenced the vocational program;

C. Will, in every contract entered into by the Registrant and a student for the provision of a vocational program, include the terms prescribed by subsection 20 (1) of Ontario Regulation 415/06;

D. Understand that every contract entered into between the Registrant and a student for the provision of a vocational program that does not include the terms prescribed by subsection 20 (1) of Ontario Regulation 415/06 is voidable by the student, and where voided a student is entitled to a full refund of all fees paid pursuant to subsection 25 (1) of Ontario Regulation 415/06;

E. Will only employ as instructors only those persons who have completed a form containing such personal information as required by the Superintendent as required by subsection 42 (1) of Ontario Regulation 415/06;

F. Will provide its approved vocational programs providing instruction leading to a Class A Driver’s License to adhere to the Commercial Truck Driver Training Standard (Class A), including only employing as instructor those persons who meet the instructor requirements of the Standard; and,

G. Have provided by e-mail to PCCCEU@ontario.ca a completed instructor qualification form for Lakhvinder Singh and proof that Lakhvinder Singh meets the instructor requirements of the Commercial Truck Driver Training Standard (Class A).
