These particulars are posted following the issuance of a Compliance Order against a registered private career college by the Superintendent of Private Career Colleges pursuant to s. 46 (1)/ (2) of the Act.

Contraventions

The Superintendent has ordered 4032322 Canada Inc., operating as World Wide Truck Driving & Forklift School (“Registrant”) to:

A. Include its complete fee refund policy in every contract entered into by the Registrant and a student for the provision of a vocational program as required by s. 29 (3) of the Act;
a. Contracts within student files provided by the Registrant did not include complete copies of the Registrants fee refund policy.

B. Include in every contract entered into by the Registrant and a student for the provision of a vocational program each provision required by subsection 20 (1) of O. Reg. 415/06;
a. Contracts within student files provided by the Registrant did not include a fee payment schedule and did not include a schedule of instruction for the program.

C. Only employ as an instructor those persons that have completed Instructor Qualification Forms, in full with the two required letters attesting to the personal experience of the instructor, as required by subsection 42 (1) of O. Reg. 415/06;
a. The Registrant provided two instructor qualification forms to designates of the Superintendent, with neither form including two letters attesting to the work experience of the instructor from persons not associated with the Registrant.

D. Provide the approved “Tractor-Trailer Driver M.E.L.T.” program in compliance with the Superintendent’s Policy Directive: Approval of Commercial Truck Driver (Class A) training programs as required by subsection 53 (2) of the Act;
a. Student files provided by the Registrant failed to demonstrate that the Registrant provided its approved program in compliance with the Superintendent’s Policy Directive. Logbooks and timesheets found within student files did not demonstrate that students were provided the full 103.5 hours required by the Commercial Truck Driver (Class A) Training Standard.

E. Keep and maintain an up-to-date copy of the Act and all regulations made under the Act at each campus of the Registrant and as required by section 39 of O. Reg. 415/06;
a. The Registrant failed to produce a copy of the Act and its regulations at the request of two designates of the Superintendent attending at the campus of the Registrant.

Required Actions

By the Registrant is required by the Superintendent to provide written confirmation signed by a person with authority to bind the corporation, together with all available supporting evidence, confirming that they:

A. Have updated your vocational student contracts to include a complete copy of your fee refund policy as required by s. 29 (3) of the Act;

B. Have provided to PCCCEU@ontario.ca a copy of your updated student contract;

C. Understand the requirement to include each of the provisions required by subsection 20 (1) of O. Reg. 415/06 into every Include in every contract entered into by the Registrant and a student for the provision of a vocational program;

D. Will include each of the provisions required by subsection 20 (1) of O. Reg. 415/06 into every Include in every contract entered into by the Registrant and a student for the provision of a vocational program;

E. Have obtained for each person employed as an instructor a completed Instructor Qualification Form, including two letters attesting to the personal experience of the instructor, as required by subsection 42 (1) of O. Reg. 415/06;

F. Currently maintain copies of all information provided under subsection 42 (1) of O. Reg. 415/06 at the campus where each person is employed as an instructor and as required by subsection 42 (2) of O. Reg. 415/06

G. Will provide the approved “Tractor-Trailer Driver M.E.L.T.” program in compliance with the Superintendent’s Policy Directive: Approval of Commercial Truck Driver (Class A) training programs as required by subsection 53 (2) of the Act;

H. Will keep and maintain an up-to-date copy of the Act and all regulations made under the Act at each campus of the Registrant and as required by section 39 of O. Reg. 415/06;
