These particulars are posted following the issuance of a Compliance Order to Appliance Technical Institute of Canada Inc., operating as Appliance Technical Institute of Canada, a registered private career college, by the Superintendent of Private Career Colleges pursuant to s. 46 (2) of the Act.

Contraventions

The Superintendent has ordered Appliance Technical Institute of Canada Inc. to:

A. Only admit into an approved vocational program those students who meet the admission requirements of the program as required by section 19 of Ontario Regulation 415/06 made pursuant to the Private Career Colleges Act, 2005.
a. Vocational student files provided by the Registrant did not include records indicating that the Registrant assessed whether students met the admission requirements of programs.

B. Include all contract terms prescribed by subsection 20 (1) of Ontario Regulation 415/06 within every contract entered into by the Registrant and a student for the provision of a vocational program.
a. Vocational student contracts between the Registrant and students did not include each term prescribed by subsection 20 (1) of O. Reg. 415/06. A designate of the Superintendent observed vocational contracts missing an itemized list of fees payable by the student, payment schedule, and the admission requirements of the program.

C. Ensure that every contract for the provision of a program that is not a vocational program adheres to the requirements of section 21 of Ontario Regulation 415/06.
a. Contracts between the Registrant and students for the provision of non-vocational programs did not adhere to the requirements of section 21 of O. Reg. 415/06.

D. Maintain files for each student that include all items prescribed by subsection 45 (1) of Ontario Regulation 415/06.
a. Student files provided by the Registrant did not include all items prescribed by subsection 45 (1) of O. Reg. 415/06. Student files were observed missing proof that the students met the admission requirements for their program, or withdrawal communications and calculations.

E. Charge prospective or enrolled students only those fees on the itemized list of fees provided to the Superintendent as required by subsection 44 (1) of Ontario Regulation 415/06.
a. Several student files provided by the Registrant included lists of fees and receipts indicating that the Registrant charged fees to students in amounts greater than those included on the itemized list of fees and further charged fees not included on the itemized of fees provided to the Superintendent.

F. Issue the credential earned by a student within 60 days of the student’s successful completion of a program and fulfillment of the terms of the contract as required by subsection 46 (2) of Ontario Regulation 415/06.
a. Student files provided by the Registrant and information provided by a student of the Registrant identify that the Registrant has not issued a credential to one or more students within 60 days of their successful completion of a program and fulfilment of the terms of the contract, contrary to subsection 46 (2) of O. Reg. 415/06.

G. Not make substantial changes to an approved vocational program without the further approval of the Superintendent as required by subsection 23 (6) of the Private Career Colleges Act, 2005.
a. Documents provided by the Registrant, together with statements of the Registrant, indicate that the Registrant made changes to an approved vocational program, such as the change of an admission requirement, without seeking further approval of the Superintendent as required by subsection 23 (6) of the Act.

H. Not offer or provide a vocational program unless the provision of the program has been approved by the Superintendent, as required by subsection 8 (1) of the Private Career Colleges Act, 2005.
a. Student files and documents provided by the Registrant, read with the approval documents of the Registrant’s “Gas Technician” program, provide that the Registrant offered and provided the “Gas Technician” program before the program was approved by the Superintendent contrary to subsection 8 (1) of the Act.

I. To operate in accordance with the law and with honesty and integrity as required by subsection 14 (1) of the Act.
a. Documents provided by the Registrant, together with information provided by the Technical Standards and Safety Authority (“TSSA”), information provided by an Employment Ontario service provider, statements of the Registrant, and the inquiries of a designate of the Superintendent, provide that the Registrant has not acted in accordance with the law and with honesty and integrity as required by subsection 14 (1) of the Act.

Required Actions

By October 18, 2021, Appliance Technical Institute of Canada Inc. is required by the Superintendent to provide written confirmation signed by a person with authority to bind the corporation, together with all available supporting evidence, confirming that they:

A. Will only admit into a vocational program those students who meet all admission requirements as required by section 19 of Ontario Regulation 415/06 made pursuant to the Private Career Colleges Act, 2005.

B. Will include all contract terms prescribed by subsection 20 (1) of Ontario Regulation 415/06 within every vocational contract.

C. Will ensure that every non-vocational contract adheres to the requirements of section 21 of Ontario Regulation 415/06.

D. Will maintain complete files for each student including all items prescribed by subsection 45 (1) of Ontario Regulation 415/06.

E. Will not charge prospective or enrolled students fees in excess of the itemized list of fees provided to the Superintendent as required by subsection 44 (1) of Ontario Regulation 415/06.

F. Will issue credentials earned by students within 60 days of the successful completion of a program and fulfillment of the terms of the contract as required by subsection 46 (2) of Ontario Regulation 415/06.

G. Will not make substantial changes to an approved vocational program without the further approval of the Superintendent as required by subsection 23 (6) of the Private Career Colleges Act, 2005.

H. Will not offer or provide a vocational program unless the provision of the program has been approved by the Superintendent, as required by subsection 8 (1) of the Private Career Colleges Act, 2005.

I. Will operate in compliance with the requirements of other laws and in a manner demonstrating honesty and integrity as required by subsection 14 (1) of the Act.
